These Terms of Service (“Terms”) govern your use of GEPSCOUT (the “Service”), operated by Sistema Hub(“Sistema Hub”, “we”, “us”, or “our”). By creating an account, starting a trial, purchasing access, or using the Service, you agree to these Terms and our Privacy Policy.
1. Service and independent status
GEPSCOUT is an independent productivity tool that checks publicly available bid notices published through the Philippine Government Electronic Procurement System (PhilGEPS), organizes results in a temporary workspace, and supports review and Excel export. Sistema Hub is not PhilGEPS, PS-DBM, a procuring entity, or a government agency, and is not sponsored, endorsed, or authorized by them. GEPSCOUT does not submit bids or act as your agent or adviser.
2. Meaning of “verified”
In the Service, “verified” means only that GEPSCOUT retrieved and parsed a listing from the identified public source at the time of the scan. It does not mean official validation, legal review, endorsement, eligibility confirmation, or a guarantee that a notice is complete, current, authentic, or suitable for you. PhilGEPS and the relevant procuring entity remain the official sources for notices, addenda, restricted documents, requirements, deadlines, bid instructions, and awards.
3. Your procurement responsibility
You must independently open and review the official notice and any addenda, confirm your eligibility, obtain restricted documents, observe deadlines, and comply with procurement, tax, licensing, privacy, and other applicable rules. You are solely responsible for decisions, submissions, representations, and communications you make using information surfaced by the Service.
4. Eligibility and authority
You must be at least 18 and legally able to enter a binding contract. If you use the Service for an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
5. Account security
You may sign in with Google or an email magic link. You must provide accurate information, protect your email account and sign-in links, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account unless applicable law provides otherwise.
6. Trial and paid access
- A first-time account receives one free trial beginning on first workspace use. It lasts 24 hours and permits three started scans. No payment details are required. We may prevent duplicate or abusive trials.
- Paid access costs ₱999 for 30 days or ₱9,990 for 365 days. The exact plan, term, currency, and price are shown before payment.
- Payments are processed through PayMongo. We do not receive or store your full card number, CVV, or bank credentials.
- Checkout is currently a one-time purchase and does not renew automatically. A purchase made during active paid access extends the existing expiry; otherwise, the new term begins when payment is confirmed.
- Refunds are governed by our Refund Policy.
7. Limited permission
While your trial or paid access is active, and subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to use GEPSCOUT for your own lawful business or professional purposes. No ownership right is transferred.
8. Acceptable use
You must not, and must not help anyone else to:
- Share access with unrelated users or evade trial, payment, rate, or access controls.
- Resell, sublicense, mirror, scrape, or redistribute the Service as a competing or hosted offering.
- Reverse-engineer or extract source code except to the limited extent applicable law expressly permits.
- Probe, attack, overload, introduce malicious code into, or interfere with the Service, PhilGEPS, or another system.
- Use results for spam, harassment, unlawful profiling, infringement, fraud, or any unlawful purpose.
- Misrepresent an affiliation with Sistema Hub, PhilGEPS, PS-DBM, or a procuring entity.
9. Public-source and workspace data
The Service fetches public PhilGEPS information and temporarily stores scan progress, verified results, diagnostics, and available attachment data in your login-bound workspace. Public-source content remains subject to the rights and rules of its source. You may use exported information only for lawful purposes and must handle any personal information it contains in accordance with applicable law. See our Privacy Policy for our own processing.
10. Intellectual property and feedback
The GEPSCOUT software, website, workflows, design, brand, and original content are owned by Sistema Hub or its licensors. If you voluntarily provide feedback, you permit us to use it without restriction or compensation, provided we do not identify you publicly without permission.
11. Third-party services and links
The Service depends on PhilGEPS and providers for authentication, email, payments, hosting, and database infrastructure. Third-party services and sites are controlled by their operators, may have separate terms, and may change, restrict access, or become unavailable. Sistema Hub is not responsible for third-party content, decisions, security, or availability.
12. Changes, maintenance, and availability
We may modify, suspend, limit, or discontinue features for maintenance, security, legal, commercial, or technical reasons. We do not promise continuous availability, a particular scan duration, or that every category, page, attachment, notice, or field can be retrieved.
13. Disclaimers
To the fullest extent permitted by law, the Service and all results are provided “as is” and “as available”, without warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, title, non-infringement, or uninterrupted or error-free operation. GEPSCOUT is not legal, financial, tax, procurement, or professional advice. No information from us creates a warranty not expressly stated in these Terms.
14. Limitation of liability
To the fullest extent permitted by law, Sistema Hub and its owners, personnel, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, opportunity, goodwill, or business; or any missed bid, deadline, award, addendum, document, or procurement decision. Our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid Sistema Hub for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where and to the extent applicable law does not permit them.
15. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Sistema Hub and its owners, personnel, contractors, and licensors from third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the Service, your content or communications, your infringement of another person's rights, or your material breach of these Terms. We will give reasonable notice of a covered claim and allow you to control its defense, subject to our right to participate and approve any settlement that imposes obligations on us.
16. Suspension and termination
We may suspend or terminate access for material breach, suspected fraud, abusive automation, payment dispute, security risk, legal requirement, or conduct that could harm the Service or others. You may stop using the Service at any time. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, indemnification, and dispute terms—survive termination.
17. Events beyond our control
Sistema Hub is not responsible for delay or failure caused by events beyond our reasonable control, including failures or policy changes of PhilGEPS, hosting, network, power, banking, payment, or authentication providers; cyberattacks; government action; labor disruption; or natural disaster.
18. Changes to these Terms
We may update these Terms to reflect Service, legal, security, or business changes. We will revise the effective date and provide notice through the Service or by email when required. Changes apply prospectively from their stated effective date. If you do not agree, you must stop using the Service.
19. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws principles. Disputes will be brought before a court of competent jurisdiction in the Philippines. Nothing in these Terms limits mandatory consumer rights, remedies, or venues that cannot lawfully be excluded.
20. General terms
These Terms, the Privacy Policy, the Refund Policy, and checkout terms form the entire agreement about the Service. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the rest will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Service. Headings are for convenience only. Electronic notices and records satisfy written-notice requirements to the extent permitted by law.
